  99. DESCRIPTION: The approval of the National Energy
  100. Board (NEB) is required for the
  101. construction and operation of all
  102. interprovincial or international
  103. pipelines for the transmission of oil
  104. or gas.  A public hearing must be held
  105. and a certificate of public
  106. convenience and necessity issued where
  107. the pipeline in question is longer
  108. than 40 kilometers.  Pipelines shorter
  109. than 40 kilometers may be authorized
  110. by an order without a public hearing. 
  111. All modifications to and extension of
  112. pipelines must be approved by the
  113. Board.

  115. Part IV of the Act requires that all
  116. tolls for the transmission of oil and
  117. gas on NEB-regulated pipelines and all
  118. tariff matters shall be filed with or
  119. approved by the NEB. A public hearing
  120. may be held in considering toll and
  121. tariff matters.

  173. and Yukon, permit the provision of

  176. convenience and necessity test.
